Pool compliance refers to ensuring your pool barrier meets the safety standards outlined in the Queensland Pool Safety Laws. These laws are in place to prevent drowning and serious injuries, particularly for young children. Compliance is mandatory for all pools with water depth exceeding 300mm.

All properties with a regulated pool that are being sold, leased, or shared (e.g., in a unit complex or hotel) require a valid pool safety certificate.

A pool safety certificate is valid for:

  • 1 year for shared pools (e.g., in unit complexes, hotels, motels).
  • 2 years for pools associated with a dwelling if the property is leased or sold.
  • 4 years for pools associated with a dwelling if the property is sold.

Any pool that can hold more than 300mm of water requires a certificate. This includes in-ground pools, above-ground pools, spa pools, and portable pools.

A pool safety inspection involves a licensed pool safety inspector assessing the compliance of your pool barrier against the Queensland Pool Safety Standard. This includes checking:

  • Fence height and strength.
  • Gate operation and latching.
  • Non-climbable zones (NCZs).
  • Window and door compliance.
  • Signage and resuscitation charts.

The duration of an inspection depends on the complexity of the pool and barrier, but it typically takes between 30 to 60 minutes.

If your pool fails the inspection, you will receive a Non-conformity Notice detailing the required rectification work. You will have a specified timeframe (90 days) to address these issues and schedule a re-inspection.

Some minor issues may be fixable yourself. However, it's recommended to use qualified tradespeople for significant repairs or modifications.

Penalties for non-compliance can include significant fines issued by the Queensland Building and Construction Commission (QBCC).
