What a Form 23 certificate proves
A Form 23 is the Queensland Government's formal record that a licensed pool safety inspector has assessed your barrier and found it compliant with the Pool Safety Standard. It is lodged on the QBCC pool register against your property, which is where buyers, agents, insurers and councils check compliance status.
When you must have a current certificate
You need a current certificate to sell or lease a property with a regulated pool. Beyond transactions, pool owners and bodies corporate have a standing legal obligation to keep the barrier compliant at all times, regardless of whether a certificate is currently active.
The risk of letting it lapse
Failing to maintain a compliant pool barrier can attract fines exceeding $26,000. Just as significantly, home insurance policies may be void if an incident occurs and there was no active safety certificate registered over the pool — which can convert a compliance oversight into an uninsured liability.
