These Terms of Use (“Terms”) govern your access to and use of the website at https://pitchpoolinspections.com.au (the “Website”) and the services provided byPitch Pool Inspections, a business of Pitch Projects Pty Ltd (“we”, “us” or “our”). By accessing the Website or engaging our services, you agree to these Terms. If you do not agree, please do not use the Website or engage our services.
1. About Us
Pitch Pool Inspections provides pool safety barrier inspections and Pool Safety Certificates (Form 23) in Queensland, Australia. Inspections are carried out under Queensland Building and Construction Commission (QBCC) pool safety inspector licence PS1218640. We operate across South East Queensland, including Brisbane, the Gold Coast, the Sunshine Coast, Redlands and Ipswich.
2. Our Services
Our services may include:
- Inspection of pool barriers against the Queensland Pool Safety Standard
- Issuing of Satisfactory Inspection Reports and Non-conformity Notices
- Issuing and lodgement of Pool Safety Certificates (Form 23) with the QBCC pool safety register
- Guidance on rectification requirements and referral to qualified tradespeople
- Ongoing pool servicing and maintenance, where arranged
3. Nature and Scope of an Inspection
You acknowledge and agree that a pool safety inspection is a visual, point-in-time assessment of the pool barrier against the Queensland Pool Safety Standard as at the date and time of the inspection. It is not a building inspection, a structural assessment, a pest inspection, or an assessment of the pool shell, plumbing, electrical systems or associated equipment unless separately agreed in writing.
A compliant result reflects the condition of the barrier at the time of inspection only. Compliance can be compromised at any time after the inspection by, among other things, the placement of climbable objects within a non-climbable zone, damage to or deterioration of the barrier or gate hardware, landscaping changes, building work, or actions taken on adjoining property.
4. Your Ongoing Obligations as Pool Owner
Under Queensland law, the pool owner (including a body corporate) is responsible for ensuring that the pool barrier complies with the applicable pool safety standard at all times. That obligation rests with you and is not transferred to us by engaging our services or by the issue of a Pool Safety Certificate.
You are responsible for maintaining the barrier between inspections, arranging any required rectification work, and arranging re-inspection and renewal of certificates before expiry.
5. Access and Site Conditions
You must ensure that, at the agreed inspection time, the pool area and the full perimeter of the barrier are safely accessible, all gates are unlocked, and any animals are secured. If we are unable to complete an inspection because access is not available or the site is unsafe, a further attendance fee may apply.
6. Fees and Payment
Our published fees are $250 for the onsite inspection and report, plus a $45 QBCC pool register fee payable when a pool is deemed satisfactory, totalling $295 plus GST. Fees are current as at the date of these Terms and may change without notice. The fee applicable to your booking is the fee quoted to you at the time of booking.
Fees for an inspection are payable regardless of whether the pool is found compliant or non-compliant, as the fee covers the attendance, assessment and report. Re-inspections may attract an additional fee. Payment terms will be advised at the time of booking.
7. Cancellation and Rescheduling
If you need to cancel or reschedule a booking, please contact us as early as possible. Cancellations made with insufficient notice, or failed attendances where access could not be obtained, may attract a fee.
8. Rectification Work and Referrals
We primarily provide inspection and certification services. Where we refer you to a third-party tradesperson or contractor for rectification work, that referral is provided as a convenience only. Any contract for that work is between you and the third party. We are not responsible for the quality, timeliness, pricing or conduct of third-party contractors, and we receive no benefit for referrals unless expressly disclosed to you.
9. Website Content and Accuracy
Information on the Website, including material about Queensland pool safety laws, certificate validity periods, penalties and inspection requirements, is provided for general information only. It is not legal advice and should not be relied upon as a substitute for the current legislation, the Queensland Pool Safety Standard, or advice from the QBCC or a qualified professional in relation to your circumstances.
Laws, standards, fees and regulatory requirements change. While we take reasonable care to keep the Website accurate and current, we do not warrant that all content is complete, current or free from error.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited.
Where our liability may be limited under the Australian Consumer Law, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
11. Limitation of Liability
Subject to clause 10, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, opportunity or data, arising out of or in connection with the Website, our services, or these Terms.
Subject to clause 10, and to the maximum extent permitted by law, we are not liable for any loss or damage arising from a change in the condition or compliance status of a pool barrier after the date of inspection, or from any act or omission of you, an occupant, a neighbour or a third party affecting barrier compliance.
12. Intellectual Property
All content on the Website, including text, graphics, logos, images and layout, is owned by or licensed to us and is protected by copyright and other intellectual property laws. You may view and print content for your own personal or internal business use. You may not reproduce, republish, adapt or commercially exploit any content without our prior written consent.
13. Third-Party Links
The Website may contain links to third-party websites, including the QBCC and Google. Those sites are not under our control. We provide links for convenience only and are not responsible for the content, accuracy or availability of any linked site.
14. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. You can view it via the Privacy Policy link in the footer of this Website, or contact us for a copy.
15. Changes to These Terms
We may update these Terms from time to time. The version published on the Website at the time you access it or engage our services is the version that applies. We will update the “Last Updated” date above when changes are made.
16. Governing Law
These Terms are governed by the laws of the State of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts competent to hear appeals from them.
